Regarding Bailable Warrant issued.
06-Feb-2025 (In Criminal Law)
Hi
I'm a accused in an accident case. I'm attending court hearing regularly.
But two police officers who are considered as CW, are not attending court hearing. They skipped the hearing 4 times.
The judge issued a bailable warrant- "Accused present. CW-19 and 20 duly served, called out absent. Hence issue B/W to CW-19 and 20."
Do they have to appear without fail?
If they don't appear what will happen? Can they be prosecuted? Can I get compensation?
What is the implications Bailable Warrant ?
Dear Sir,
Whether CW19 and CW20 appears or not appear the Court will proceed to pass judgment and probably the Accused may be acquitted for not producing above witnesses. Irrespective of acquittal of Accused the victim will get compensation from the Motor Vehicles Tribunal. You need not bother about the implications of bailable warrants against them.
