Regarding Bail. Want To Know The Meaning Of Court Order
24-Jun-2023 (In Criminal Law)
Order by high court- it has been brought to this court by learner counsel that on account of orders of the date -----, investigation have been stayed thus, in utter violation of the settled law, impels this court to recall the order. However, the said order stands modified with directions that consequent upon presentation of report under sec 173 cr.p.c, further proceedings shall remain stayed.
Now my question is whether I have to take bail or not when investigation officer submit the chargesheet in lower court?
hello at the outset just reading brief order of Hon'ble High Court it appears that police investigation was stayed which is restored and now police will continue to investigate and order is modified that after submission of chalan u/s 173 crpc further proceeding i.e trial proceedings are stayed. you will have to secure bail if no directions on pre- arrest is given.
