Regarding anticipatory bail related to section 420

25-Nov-2023 (In Criminal Law)
This is case where a person has filed case on me for Rs. 5000 fraud. I did signed a cheque for Rs.5000 and gave it to a person to hand over to another person. But first person took out the amount of Rs.5000 by doing some forgery. I have no idea, how he did that. Benificiary person never got the amount and filed case on first person and me. nThis is 10 year old case. Police informed me that there is arrest warrant in my name. Will I get anticpatory bail in this case?

Consider a scenario where ‘A’ has committed a non-bailable offence and he is aware that he can get bail before he gets arrested. ‘A’ may invoke one of the most significant defences of personal liberty defined under Section 438 of the Code of Criminal Procedure, that is, anticipatory bail. If a person believes they are likely to be arrested on non-bailable charges, they can move to the Court of Session or the High Court for anticipatory bail. * But you have prove that I will co-operate with Trial and investigation. in case of any breach the AB will be cancelled
