You cannot get discharged without signing a bond. You only get discharged when the Magistrate is convinced that making you sign a bond would be a waste of the court's time and an unnecessary restriction on your freedom. However, you can alternatively approach High Court for the quashing of the notice given by the executive magistrate stating that the magistrate has given notice without recording sufficient reasons.

Proceedings under Section 130 BNSS (earlier Section 107 CrPC) are preventive in nature, not punitive. There is technically no concept of “discharge” as in trial cases. The Executive Magistrate forms an opinion based on police information, and if satisfied, may direct execution of a bond for maintaining peace.

Your situation needs to be handled carefully — most people make a mistake here. Proceedings under Section 130 BNSS are preventive in nature, so technically there is no concept of “discharge” like a regular criminal case. But that does not mean you have to sign a bond blindly. If the police report is weak or there is no real apprehension of breach of peace, you can file a proper objection and request the Executive Magistrate to drop the proceedings altogether. This is the correct legal approach. The problem is, in places like Sahibabad and Shalimar Garden, many matters are disposed of mechanically — people appear once and sign the bond without contest. That goes on record and can create issues later. A well-prepared objection, pointing out lack of evidence and misuse of preventive action, can get the case closed at this stage itself without executing any bond. That is where proper handling makes the difference. We regularly handle such preventive proceedings and know exactly how to structure objections so that the Magistrate is inclined to drop the matter instead of simply asking for a bond. If you want, I can guide you on the exact approach or prepare your objection so this can be closed properly from the beginning. best Regards, vaibhav Sangam Mishra Sangam & Sagar Law office LLP

If after investigation the executive Magistrate feels that there is no real danger of breach of peace or there is not enough evidence against you, he will discharge you under Section 137 BNSS without signing a bond and the proceedings will be dropped.. Lawyer fees for Section 130 BNSS (formerly known as 107/111 CrPC) cases depend on the city, the lawyer's experience, and the complexity of the case.
