"My nephew is the main person in a suicide case. He refused to marry a girl, and she took her life.My father is his uncle but has no connection to any of this. He doesn't know the girl or her family. He wasn't involved in the relationship or the wedding.But police in our area sometimes question relatives to pressure the main person. We want to protect my father from being unnecessarily dragged into this.We have CCTV cameras in our house that show he wasn't involved.Please advise how we can ensure he is not questioned or implicated. We want legal protection for him.Thank you.

What is your age of your father? If he is senior citizen, police can’t investigate with him with formal notice in written. Preserve the CCTV footage. It will be your father’s proof of alibi. If you feel that police will falsely implicate your father and try to arrest, you can also approach for anticipatory bail.

Agar kisi ko STF ne chori ke maamle mein pakda hai, toh zamanat (bail) ki prakriya thodi gambhir ho sakti hai kyunki STF aam taur par bade cases handle karti hai. Chori ke maamle mein aam taur par IPC (ya naye kanoon BNS) ki dharaayein lagti hain. Agar chori mamuli hai, toh bail milna aasaan hota hai. Lekin agar STF involve hai, toh ho sakta hai ki maamla bada ho ya usme koi gang involved ho. STF ke cases mein aksar investigation gehri hoti hai. Isliye bina deri kiye kisi expert lawyer se salah lein taki remand ke waqt vyakti ke adhikaaron ka hanan na ho. Kya aapke paas FIR ki copy ya sections ki jankari hai?

Sarkari zameen ki kharid-farokht mein gawah ki liability sirf document ke execution tak hoti hai, jab tak ki uska kisi fraud ya conspiracy mein active involvement na ho. IO ke paas gawahon ko chunne ki power hoti hai, lekin wo arbitrary dhang se kisi material witness ko investigation se bahar nahi nikaal sakta kyunki ye Fair Investigation ke siddhant ke khilaaf hai. Agar IO gawah ka naam nikaalne ki koshish karta hai, toh aap Mahender Chawla vs Union of India ke ruling ka sahara le kar witness protection aur fair trial ki guhaar laga sakte hain, Aap high court mein Article 226 ke tehat writ petition file karke bhi IO ko sahi dhang se investigation karne ke liye direct karwa sakte hain.

I depends whether it is minor bail or major bail. Both have different courts according to sections. What are your offences in the section? Also, please note that some of the court takes only 2-3 days for listing, while some other takes a week. Also, sometimes due to pendency of the court it gets listed on high serials, which is impossible to reach at the same day. All depends upon the court to court.
