rape case after aarya samaj temple marriage

sir one boy who make physically relation with my friend on behalf of marriage. after get government job boy deny for marry. girl give many complain in cm help portal pm help portal and sp office but no FIR lodge. after threaten of police boy marry with girl in aarya samaj temple. and after he deny to her keep with him. girl give a application to police station but police lodge only 498a case for mental harrassment. and change the girl statement. after that she lodge a rape case and ipc 313 on him through court. police says a wife cant lodge rape case on his husband. we are not doing anything . we can not investigate. and submit FR report. please tell what we do now.

Since now you are legally married then you can always file a domestic violence case against your husband. You can also sue him under section 125 CrPC and claim your monthly maintenance. And if you wish to go and live with him then you have to file a petition under section 9 HMA. For more legal assistance I am just a call away.

hello client as i can see your issue is seems yo be very much urgent issues as a matter of fact is concerns you have been blackmailed as well as you have been used on the name of marriage as due to pressure from police side the other peraon got married in arya samaj mandir and now they are not ready to keep the girl with them . so in my view you people nees to take action through high court then only action is possbiel otheriwise things can get more unfair for you.

The court's observation is 100% correct that a rape case can't be made out against him. But if the statement under sec. 164 has not yet been framed a lot more can be done here. For more information feel free to consult me.
