Questions regarding CRPC & chargesheet

On complaint of my neighbour police filed a FIR against a man. And she put my name as eyewitness without my consent in Chargesheet & IO wrote my false statement in Chargesheet without my consent & my presence to help complainant illegally. Now what actions I can take against the IO & complainant??

Although I have answered this question earlier but since its repeated let me add few more suggestions. Before going forward with the suggestion of filling case for malicious prosecution against the two do not forget to send an application in this regard to relevant police authorities as the same would be required during the proceedings in the court case.

If you have not witnessed anything with respect to the matter of the Complainant then you can also file a complaint against the Complainant. However, you do not need to do so as the Court will issue summons for your presence in this matter then you can also apprise the court that you have not been involved in this matter and you have not witnessed anything. The copy of the complaint can be filed before the court, when you receive the summons.

Dear client you have a very strong ground to challenge the false inclusion of your name as a witness. Here, what you can do: 1- file a complaint against the IO for false evidence 2- file an application before magistrate under section 340 CRPC 3- move for deletion of your name as a witness under section 311 CRPC 4- or file a petition in High Court, if necessary 5- also lodge a defamation case against the complainant Hope this step will help you for the further action plan in your case, and if you need any assistant, you can directly reach out to me
