This is cognizable offence. In such cases police can register an FIR.. threat to life is serious offence..police can register an FIR without magistrate order..first you prepare your complaint and write all contentions on your part. Then go to police station and submits your complaint

Yes, criminal intimidation involving a threat to life is a cognizable offence under Section 506 of the Indian Penal Code, particularly when the threat is of death or grievous harm. In such cases, the police can register an FIR without seeking prior permission from a Magistrate. Cognizable offences empower the police to act suo motu, investigate, and even arrest (subject to procedural safeguards), without court approval at the initial stage. If the threat is serious and specific (for example, a direct threat to kill or cause grievous injury), it falls under the aggravated form of criminal intimidation, which is treated more seriously in law. If the police refuse to register an FIR despite disclosure of a cognizable offence, you have the following remedies: * You can submit a written complaint to the Superintendent of Police under Section 154(3) CrPC * You can approach the Magistrate under Section 156(3) CrPC seeking directions to the police to register FIR and investigate In summary, threat to life is clearly a cognizable offence, and police are fully empowered to register FIR without any Magistrate’s order.

Criminal Intimidation is recognised as an offence under Section 351 of the Bharatiya Nyaya Sanhita, 2023, which deals with threats to life as well. Where the threat involves death or grievous harm, it falls within the ambit of Section 351(3). However, an offence under Section 351(3) is NON-COGNIZABLE. Accordingly, the police are not empowered to register an FIR or initiate an investigation on their own. The appropriate course is to file a complaint under Section 174 of the Bharatiya Nagarik Suraksha Sanhita, 2023, before the jurisdictional police station. Upon such a complaint being filed, the Magistrate may examine the matter and, if satisfied, direct the police to investigate. The maximum punishment for criminal intimidation under Section 351(3) of Bharatiya Nyaya Sanhita, 2023, is up to 7 YEARS, along with a fine.
