Under Section 13(1)(ia) of the Hindu Marriage Act, 1955, a marriage may be dissolved by a decree of divorce on the ground of cruelty. Criminal Intimidation is recognised as an offence under Section 351 of the Bharatiya Nyaya Sanhita, 2023, which deals with threats to life as well. Where the threat involves death or grievous harm, it falls within the ambit of Section 351(3).However, an offence under Section 351(3) is NON-COGNIZABLE. Accordingly, the police are not empowered to register an FIR or initiate an investigation on their own. The appropriate course is to file a complaint under Section 174 of the Bharatiya Nagarik Suraksha Sanhita, 2023, before the jurisdictional police station.Upon such a complaint being filed, the Magistrate may examine the matter and, if satisfied, direct the police to investigate. The maximum punishment for criminal intimidation under Section 351(3) of Bharatiya Nyaya Sanhita, 2023, is up to 7 YEARS, along with a fine.You are advised to seek appropriate legal assistance in this regard.
