Quashing of False and Retaliatory FIR under Section 528 BNSS

18-Sep-2026 (In Criminal Law)
I seek legal advice regarding quashing of FIR No. 181/25 registered at Rohtas Police Station, Bihar. The FIR is completely false and retaliatory, arising from an ongoing family dispute and earlier FIR No. 325/24. Police have issued a notice under Section 35 BNSS and indicated that a chargesheet may be filed. What remedies are available before Patna High Court under Section 528 BNSS? What documents are required, and can proceedings be stayed?

I can assist with a detailed assessment of your FIR and advise on the appropriate remedy before the Patna High Court under Section 528 BNSS. I will first examine FIR No. 181/25, the earlier FIR No. 325/24, the Section 35 BNSS notice and the available case records to assess the grounds for quashing and interim protection. Please share the FIR, notice, previous FIR and any relevant orders/documents. After reviewing them, I can explain the proposed legal strategy, required pleadings and next steps for filing before the High Court.

you can file a quashing petition in Patna High Court to quash the FIR , but before that it is important to know what sections are mentioned in FIR whether the family members included in FIR need to file bail or not. So it is advised to share the FIR details first and then after it can be suggested clearly whether the quashing petition is filed first or later. feel free to contact me. thanks and regards

yes, you can file a qashing in the matter and It can be helpful to you. I would completely end your name out of the case and you will be Free from the matter. That is the reason why it is preferable to file quashing in your matter.

For filing a quashing petition before the Hon'ble Patna High Court you are required to get the certified copy of the FIR, Chargesheet and the Cognizance Order (if available). The aggrieved person will have to sign a vakalatnama and a pairvikar will be required to sign the affidavit. You can contact the Advocate for further concrete information.
