Quashing of charge sheet after framing of charges

03-Dec-2024 (In Criminal Law)
My brothers wife has filed false cases against me and my family under sections 498a, 313. Police have filed charge sheet and case is committed to sessions Court and charges have been framed. I have good satisfactory evidence to prove my innocence. Is it a better option to go for quash in High Court at this particular point of time or should go for trail. If so how many years will it take to get acquit in trail Court. Plz guide me

Well, you can either co operate with the Police in its investigation and face the trial before the concerned Magistrate or else, you can file a quashing Petition in High Court, in which, you get the result within a faster period.

Well, it will be best, if you file a case in High Court, as the case will go in High Court in a fast paced manner, whereas in lower court, it may go on for years and years. You can contact me to file Quashing Petition in High Court.

It's better to present evidence to prove your innocence in the Sessions Court rather than going to the High Court to Quash it. A Quashing Petition can serve as a remedy to challenge the decree issued by the Sessions Court.
