Quashing for Fake 376 by a learned lady

12-Mar-2023 (In Criminal Law)
Hello, Advocates In one instance, a knowledgeable woman provided many versions in FIR/161 and 164. She discusses a fraudulent promise to marry, an actual rape, and dishonesty in FIR. There is no evidence of a rape in the Complaint. She stated that rape occurred in June and July when she visited him by driving 300 kilometers. There is no mention of rape or June or July in verse 164. Rape occurred in 161 two months, she claimed, in February and March, but the FIR makes no mention of June and July. What occurs in these situations

Well, your case seems strong. You can lodge a case in High Court for quashing the FIR. Whatever you said, seems one who got allegedly raped is lying. Hence, you can file a case of perjury against her and can seek monetary compensation too.

Sexual intercourse on the pretext or promise of marriage does not account for the offence of rape. If the relationship was consensual, there is no case made out and the FIR can be quashed. We need to go through the contents of the FIR and the statement of the lady and understand as to on what grounds she has alleged the commission of rape and on what grounds can we get the FIR quashed.

Yes you can come out of this case. It is a very strong ground that there are material contradictions between statement recorded under 164 of IPC and FIR You should approach the High Court for quashing for the FIR on this ground alone that there are material contractions between the FIR and the statement recorded under 164 of IPC
