Quashing A False Fir Filed Out Of revenge

My girlfriend after i discovered she is having multiple relationships i confronted her. Now out of revenge she filed a false rape case on me..i have all the evidences that she was clearly cheating on me.recently got bail .how easy is it to quash the fir what all factors depends on it and how long it wil take.i dont have any criminal histories in the past.

Since it is a 376 the high court have got the discretionary power to quash the FIR. The high court might quash the case if the girl admits that her life is getting spoiled because of ongoing case or if you are able to prove that she told a lie before the police etc. For more legal assistance I am just a call away.

The Delhi High Court has observed that the FIR and chargesheet can be quashed if the allegations made in the FIR or complaint or the evidence collected, though remaining uncontroverted, do not disclose the commission of an offence.
Once quash petition filed and police submit the report to the court. The quashing of FIR takes between 2 to 5 hearings to get the case quashed which will take anywhere between 10 days to 3 months. The law is supreme. It gives rights to every person without bias.

Quashing of an FIR depends upon the consideration of an evidence furnished by you, wherein you will be able to satisfy the court that you both were in relationship and its a consented thing. To take revenge she had filed a false FIR. Further chargesheet needs to be seen what incriminating evidence does prosecution has.

Quashing can be done on merits or on the basis of compromise. On merits it’s only possible if you have conclusive evidences in your defence.

put all the evidences in your support and go for quashing .....judge will decide the credibility of evidence and accordingly will pass the order ....Gen it takes 3-4 dates for the same... the credibility of evidence will decide it
