public drinking by me and my brother .

me and my brother were caught by police for legal drinking , after brethalyser reports our alcohol levels came 0.033 , 0.112 . We dont know if the police has made a FIR or CHALLAN against us , our parents has said that we are on our own on this , we dont know the court dates or anything , what are the outcomes if we fail to pay challan .

There will be no FIR. The police officials must have filed a kalandra and consuming alcohol at public places can attract a fine only. The maximum fine is Rs.5,000/- which can be lowered or can also be abolished. It depends on case to case.

if the police has filed challan or fir, you will receive the summons at the address that you provided them. Then after receiving the summons you are bound to attend the court and proceed accordingly. Moreover if you have the details of the concerned Police Officer you can call him and ask the details as a matter of right.
