Process to file complaint against hawala transactions
19-Apr-2023 (In Criminal Law)
Hawala (also spelled hewala, havala, or hawaleh) is an informal value transfer system that operates outside traditional banking channels. According to the United Nations Office on Drugs and Crime (UNODC), a typical Hawala transaction involves a person in Country A who wants to send money to someone in Country B. The sender gives the cash (plus a commission fee) to a local Hawaladar (money broker). This broker then contacts another Hawaladar in Country B, instructing them to pay the equivalent amount to the recipient often without physically transferring any money across borders.
Hawala relies heavily on trust, personal relationships, and the honor system, rather than legal contracts or formal banking procedures. Although it's widely used for legitimate reasons especially in regions with limited access to banking its anonymity has also made it a tool for money laundering and other illicit activities.
