Procedure to prove death of deceased for death certificate

Dear Sir, Kindly help me regard proving death for my parents and elder brother . I am A1 . We are accused of false case 307 & 498a by bangalore session court and cases are going on from 2015. we were regular to court but last date we had not attended in month of June as before week of date my elder brother age around 37years (A4) passed away during his treatment in hospital . While reaching our native in UP for his funeral and to complete death ceremony my parents passed away due to heart attack or by shock of his elder son death. Now i am struck in my entire family responsibilities in my native place to save my rest family i.e. my brother family and kids . Where on 1st date absent only court has ordered for Appearance of Accused and NBW Now i can get only death certificate of my brother as he passed away in hospital and we had burn him in BBMP so we got receipt and all. where my parents death certificate require to apply in my native which may take longer time formalities .

Your story is heartbreaking. You must be having an advocate who is defending you in Bangalore Court. It is enough if your advocate brings the whole matter to the attention of t Court, and next when you attent he will file a warrant recall.

You can appear before the court and file an application for recall of the NBW issued by the honourable court on the last date of hearing do you do you are not presentbefore the court when the case was called. To defend your bona fide you can produce the death certificate of your parents and elder brother

Sir just file an application under section 70(2) for recall and cancellation of NBW stating the reasons of death of your brother and parents, further file a memo stating the death of your parents and brother if they were accused persons in the case and take time to produce the death certificates of parents.
