Procedure to avoid summon on unavoidable health issues

Sir/Mam, My mother was government medical officer while making an accident registry, now she got retired. After many years court has sent summon for her to appear as evidence for the old case but she is ill now and could not attend in future. What is the procedure to get out of such summons due to unavoidable health issues?

Hello sir I can understand Ur situation, usually court summons is calling for witnesses to initiate the case for trial but if witness is not in position to give evidence before the court means they get permission from high court to avoid it based on situation s

Chapter VI sec 61 to 90 of the Cr.p.c deals with this .
As per the law a person who is summoned is legally bound to appear before the court on the given date and time.Wilful disobedience is liable to be punished under section 174 of IPC.Its a ground for contempt of court.so try to attend at least once and then you can file a petition before the court for the exemption to appear the court in future based upon the health issue.
