Live-in relationships are not illegal in India, but they do carry legal consequences. Installing CCTV/spy cameras in private spaces like bedrooms does NOT give protection; rather, it may itself amount to offences under IPC/IT Act for violation of privacy, voyeurism, and illegal surveillance. Consent for sexual relations must be free, voluntary, and ongoing; no recording can override criminal allegations if consent is later disputed. False cases are a concern, but courts also examine conduct, contemporaneous messages, duration of relationship, and circumstances. Practical precautions include: Entering into a written live-in agreement clearly stating consent and expectations. Avoiding promises of marriage unless genuine. Maintaining normal, respectful communication records (messages/emails). Not recording intimate acts or installing surveillance in private areas. Seeking legal advice before cohabitation.

Your fear is understandable, but some of the assumptions in your question need legal correction so that you don’t take steps that actually put you in more trouble. First, consensual sexual relations between two adults, whether in marriage or in a live-in relationship, are not illegal under Indian law. Live-in relationships between consenting adults are recognised by courts and are not per se an offence. However, criminal cases arise when allegations are made regarding lack of consent, deception, coercion, or breach of trust. Second, installing CCTV or spy cameras inside a private living space does not give you any protection under IPC Section 96 (right of private defence). Section 96 relates to defence against physical offences and has nothing to do with recording private acts. In fact, installing cameras or recording intimate moments without explicit, informed consent of the other person can expose you to serious criminal liability under voyeurism, privacy violations, IT Act offences, and even strengthen allegations against you. Cameras in bedrooms or private spaces are strongly discouraged and can backfire badly. Third, in cases of sexual offence allegations, video recordings of intimate acts are rarely accepted as a defence and often create additional offences. Courts focus on consent, surrounding circumstances, conduct, communication, and credibility. Possession or use of such recordings can itself become an offence, irrespective of your intent. Fourth, false cases are not presumed by law. Courts do recognise misuse of laws, but they do not assume that a woman’s complaint is false merely because the relationship was consensual earlier. At the same time, conviction does not happen automatically. Investigation, evidence, medical records, messages, conduct before and after the incident, and contradictions are all examined. If you are considering a live-in relationship, the real precautions are behavioural and legal, not surveillance-based: • Be transparent and honest about marriage, future plans, finances, and expectations • Avoid promises you are unsure of fulfilling • Maintain respectful communication and written clarity (messages, emails) • Do not coerce, threaten, or emotionally pressure your partner • Ensure consent is continuous and voluntary • Exit relationships cleanly and peacefully if things do not work out If at any point there is a dispute or threat, do not panic or retaliate. Preserve communications, avoid confrontation, and consult a lawyer early. If a false FIR is filed, remedies like anticipatory bail, quashing, and defence during trial are available, and courts do grant relief where allegations are motivated or false. In short, CCTV or spy cameras are not a legal shield and can seriously harm you. The safest protection is lawful conduct, clarity in relationships, and timely legal advice—not surveillance or self-help measures that violate privacy.

the only precaution which you can avail is to get an affidavit notarized stating that you and your partner are staying in live in relation and there will be no legal implications of such. if your partner can sign the affidavit that will be sufficient for you for your private defence because post that there cannot be any complaint regarding any of the offences

IPC 96 does not justify recording a partner without consent. Installing CCTV or spy cameras in private spaces is illegal and may create criminal liability. Protection lies in lawful conduct, clear communication, written records, and relying on due process and evidence, not secret surveillance.
