judicial magistrate in general has power to direct further investigation. under section 173(8) of criminal procedure code, a magistrate has power to order further investigation even after filing of a charge sheet if the magistrate feels there is a need for further investigation. and so an accused can at anytime file a petition for further investigation.

Under Section 173(8) Cr.P.C. the Magistrate could direct reinvestigation or further investigation to collect further evidence and the new report to be submitted by the Investigating Officer would be governed by Sub-section (2) and (6) of Section 173 Cr.P.C.
