As he is already in judicial custody, you have to apply for regular bail at sessions court consult advocate to do the needful with certified copy of the F.I.R and any supporting documentary evidence to show that your brother is innocent. There is a chance f getting bail but we have to go through the facts and circumstances of the case and it also depends upon the discretionary power of the court.

Hi...If you have evidence or any proof that during life time of your brother wife they both are led happy marital life then you may have a chances of getting bail and if she left death note behind her by mentioning your brother name it will be difficult for you.
