No, since section 354 of Indian Penal Code is a cognizable offense and is a non-bailable section, so Police Officer has no power to give bail. Police officer has power to give bail only in case of bailable offences. You have no other option than to surrender before concern judicial magistrate for getting bail under Section 437 of Criminal Procedure Code. In India mistake of fact is not punishable but mistake of law is not excusable and punishable, therefore if you are a major and understand the nature and consequences of the offence then you are liable to be punished according to the procedure established by law.
