Police signed a letter for not contacting a girl is it legally binding

10-Jul-2023 (In Criminal Law)
I had a complaint registered against me by the family of a girl I know. The complaint was that I talk to her or otherwise have contact with her which the family did not like. I was made to sign a letter penned by the police constable which said that if I contact the girl again, there can be an FIR lodged against me. Is this legal? Is it legally binding? If I am caught in this offense, what kind of punishment can I expect? PS I am not troubling the girl. We happen to be really good mutual friends.

Merely contacting a girl or talking to her in a gentle way is not an offence. If the girl is offended, she has to complain. Her family cannot lodge a complaint against you, unless she is a minor or incapacitated for any offence alleged to have been committed by you against the girl. In the instant case, the girl has not complained and you say you happen to be mutual good friends. So there is no offence.

If the constable has taken your signature for a letter purported to have been written by you (or forced to sign a letter written by the constable himself) saying that if you talk to the girl, there can be an FIR lodged, then such a letter does not give raise to any cause for action against you. If an offence is committed, nobody's permission is required for prosecuting such criminals. You need not worry, no action can be taken against you by just the letter.

If police or the girl and her parents don't want interference from you ,it is her right and freedom ,and you need to respect it without much fuss.you should be thankful that police gave you enough opportunity to mend your self and hence its better be away .
