Police Not Taking Action Against FIR

Recently i did a FIR 420 against real estate mafia who has taken money and not gave me the possesion of flat. I had to give my hard to file a FIR against him since he has settled the police seniors officers as well as well as political contacts.. now police not taking action against him not arresting him since his mobile no. Is power on what should i do i am like helpless as his contacts ...is very high....

As the FIR is registered police eventually will be forced to take action against him however considering your case time is of the essence as it pertains to possession of property. Therefore in order to make police take action against the accused and to ensure proper investigation be taken against the accused, you can file a application under 156(3) crpc for monitoring of investigation before the concerned magistrate of the police station. Court has the power to monitor the investigation and also direct the investigation to be finished in a time bound manner.

However it can only happen after the situation improves and lockdown is lifted. In the meantime I would also request you to take precautions as mostly such well connected people tends to make cross FIRs against their complainants in order to put pressure on them.

hello client as you have mentioned tht police department is not at all helping you. as your report allready got registered with the police thats all. the next steps of arrest taking cognigence of the matter as well as custody investigation etc is not even started till now. in this case you are not at all helpless you can still take direct actions against the police officials who are not at all taking action against the builder as well as you are able to directly take action against the builder also. for this you need to consult a criminal advocate for the solution of your issue you need not to worry at all law is with you.

Hi, need not worry. If the police officials are not registering your complaint / FIR, then you may file a complaint under 156(3)/200 CrPC before Hon'ble Chief Metropolitan magistrate.
