Police calling post case disposal

11-Dec-2023 (In Criminal Law)
Hello team, I had lost a phone which was recovered after giving bribe to Police ( they wouldnt have given me otherwise ) I dodged some bribe and the CRPC website shows that case is disposed (Jan 2020) as I have my phone now. Yesterday after almost a year, I got a call from police that I have to visit the court and say that yes I have the phone. Is that legit ? or is it another way to cash some more bribe. What are the consequences if I dont go to the court Regards

Well, I am not able to understand : Why the Police Officials are calling you again as and when the case has already been disposed. It seems something is fishy. Don't worry at all, I will guide you - what needs to be done.

If your phone was stolen then it should be a case under section 379 IPC against the offender. And as you said if the case is disposed then it means accused was acquitted. But generally when FIR is lodged and subsequently an accused is apprehended then police cannot give phone to the complainant without court's permission and the complainant has to apply to the court for it under section 457 CrPC.
