Police Accepting that B report filled was incorrect

I had filled an FIR and police closed it with B report. I have challenged the B report in Magistrate court and also given a corruption letter against ACP to the commissioner of police along with necessary evidence. The new DCP who joined recently agrees that B report should not have been filled by police as there is clear evidence. My Question is 1) Can the police file any application to Magistrate court to withdraw the B report and investigate the case based on evidence i have given them. 2) Can the Accused also be heard by Magistrate court when i am changeling the B report filled by police.

When you have filed an application to reopen the B Report then court will peruse it and direct the concerned police to reinvestigate the matter and submit the report. Hence, burden is on you also to prove the case by providing appropriate evidence to the court

No the Police is not having power to withdraw the b report which is submitted by them. you have only option to challenge the B Report. After challenging the B Report the the magistrate will hear you and pass the necessery orders on B Report whether it is sustainable or to be set aside and direction required to reinvesting the case.
