One person filed a false case regarding laptop theft.

Sir one of my friend's laptop got stolen and he is framing us as the culprits. Haryana police took us to the station and beat us and made us write a statement that we should pay the laptop's with money.. police didn't hear our side nor they have any proof that we did the crime. We need to file a defamation case against the person who did this to us.

It is your legal right under the Indian law to plead either guilty or not guilty. beating in police custody without any evidence or reason to believe that it is impossible to get confession without physical beating to criminal is crime in itself. u must file a case of defamation along with police complaint against the offending police officer

You can file an defamation case whenever you want but what proof you have so later you can prove your case..is the police took u before magistrate or in court, if firstly file an anticipatory bail if police officials are harrasing you and called you unofficially without any notice if the sections are non bailable..
