One partner cheated people can they take action against the other

There was no partnership deed between the partners they worked together in many projects but one partner cheated the other and took money, later there was no contact between two, 1st partner use to cheat people by selling one property in two different persons name now aggrieved can file case against the 1st partner. My question is whether other partner can also get his name involved in such case where he was not involved

They can file a case under Criminal Breach of Trust and cheating. Even in the absence of a partnership deed, you have to demonstrate partnership by way of subsequent business conduct. You can contact me further if you wish to take this forward.

yes you can also get roped in such cases as if you have a past involvement with your earlier partners is is deemed to be a oral partnership. A signed partnership deed is not mandatory to prove partnership. You must prepare for a legal defence specially if the consequences are of criminal nature like cheating, breach of trust etc.

If the other partner has been part of transactions and the amount is recieved in joint account then chances are that both can be made liable and action can be taken as per law against both. However, it depends on the facts and nature of transactions to give precise advice.
