Once the 498A FIR is quashed by the Delhi High Court, is the presence of the complainant necessary to withdraw the cases from the Magistrate Court? DV, 498A & a private complaint to Magistrate under Section 200 CrPC read with Section 156(3) CrPC(currently I am not a party in this private complaint.)

Dear client Though it not mandatory for you to be present. It will be advisable for you to be present in court along with a certified copy of the quashing order. In case there is any settlement agreement that you have signed with your wife. Do carry a copy of that too and record your statements in court where the matter is pending. Please feel free to get in touch in case of any further query. Regards Adv. Abhinav Sharma

Yeas that is quite obvious the presence of the complainant is absolutely necessary because quashing has been done in 498A and rest of the matters are still pending and without complainant the cases cannot be withdrawn
