This is a very important GST issue, and many businesses lose money here because they rely on assumptions instead of the correct legal remedy. Short answer (so you understand the risk clearly): GST law itself does NOT automatically recover your invoice amount for you, even if you have already deposited the GST with the Government. That is where most taxpayers get stuck. What the law actually says (in simple terms): Under GST, you are liable to pay tax once an invoice is raised, irrespective of whether the customer pays you or not. If you have already deposited the GST and the buyer has not paid the invoice value, the Government will not refund or recover that amount on its own. GST law is meant for tax collection, not for commercial debt recovery. Then what protection does the law give? There are legal mechanisms to protect you, but they are not automatic and must be invoked correctly: Contractual enforcement Civil / commercial recovery action Strategic use of GST records as evidence In some cases, criminal angle (only if facts support it) Most people make the mistake of filing wrong applications under GST, which get rejected and waste time. Why this needs careful handling: If you take the wrong route: Your recovery case becomes weak Buyer gets time and leverage Limitation period can expire GST already paid becomes a permanent loss What you should NOT do: Do not assume GST department will recover money for you Do not stop filing returns or reverse tax without legal basis Do not send informal notices that harm your future case Professional advice: There is a correct legal route to recover the invoice amount (including tax component), but it depends on: Nature of transaction Terms of invoice / agreement Buyer’s conduct Time elapsed This cannot be answered generically. One wrong step can cost you the entire amount. If you want, I can review your invoice and transaction and tell you the exact remedy available in your case. This is a matter where strategy matters more than filing. You may contact me for a proper consultation so we proceed safely and effectively.

Under GST law, there is no specific provision that allows recovery of the GST amount from the buyer simply because the supplier has already deposited the GST with the government. If the supplier has issued an invoice and paid the GST, but the buyer has not made the payment, it becomes a commercial dispute. The GST department does not recover such amounts on behalf of the supplier. In such cases, the supplier’s remedy lies under civil law, such as issuing a legal notice or filing a civil suit for recovery of dues, or taking action as per the terms of the contract. GST law mainly governs tax compliance and not payment recovery between parties

Under the GST law, if you have raised a GST invoice and already deposited the GST amount with the government, recovery of the invoice value (including GST) from the buyer is primarily a civil liability, not directly recoverable through GST authorities. The CGST Act does not provide a direct mechanism for the seller to recover unpaid invoice amounts from the recipient. However, Section 16(2) of the CGST Act requires the recipient to pay the value of supply along with tax within 180 days; otherwise, the recipient must reverse Input Tax Credit with interest. For recovery, you may initiate civil proceedings, arbitration (if agreed), or proceedings under the Negotiable Instruments Act (if cheque dishonour is involved). In cases of fraud or cheating, criminal action may also be considered.
