Non arrest by police in case of assault

08-Nov-2023 (In Criminal Law)
Hi, my father was assaulted by five people at his village and was admitted in ICU in a private hospital. I had lodged an FIR with the rural police station on 01 Nov 19. However till date no arrest have been made against the accused and they are roaming Scott free. Medical reports revealed that my father has serious fracture and torn forehead and broken jaw. The witnesses also gave statement in favour of my father but still no arrest have been made. Can you please confirm the procedure of arresting the accused and why they have not been arrested yet?? Can the non arrest be challenged in the court??

once you filed complaint before, you have to ask for the FIR number and request them to take action immediately providing necessary details otherwise something works beyond your control , check whether they have taken anticipatory bail or Bail before magistrate .

Dear Sir
It is the game muscle power and money power. In such circumstances you may approach High Court under section 482 of CrPC and seek a direction for investigation by Higher Police officers or to hand over to COD or CBI. You will get justice immediately nothing to worry.
