Dear client The guidelines were laid down by the SC in Arnesh kumar v state of WB. However there is no straight jacket formulae for arrest. In case of a cognizable offence, police has the power to arrest. You should apply for anticipatory bail. Feel free to get in touch to discuss further

It is a bailable offence but there are certain procedure that has to be followed for taking bail from the concerned police authority. Bailable offence are those offences where punishment is for or less than 3 years . But there are some exceptions to this rule .
