Nick name used in notice should the person take anticipatory bail

Someone file false case on my friend under section 379/34 ,but as he doesn' t know exact name,so he file case on his nick name,which even neighbours doesn' t know,but in court notice his father name is right,so whether he should go for anticipatory bail or not?

Detailed facts of the case is imporatant, documents you have received is important, detailed history of your issue is important, why the father of the accused has been targeted, upon clear discussion it can be guided to you properly.

If the summons served and received by them and the person is using the said name in any of his part than the same should be a valid service and you have to take the bail otherwise he may refuse the same for the time being but court may issue warrant against his name which please note

You are notified refering your nick name but having your correct father's name and address and it is possible due complaint is only know your nick name so you have to face the trail before LD court and hence first of all you have need to be granted bail either by trial court or by the court having power to grant anticipatory bail

Obviously he should go for Anticipatory Bail. As his original name was not reflected in the FIR but his father's name is reflected in the FIR that means, he is the right person, whose name has been reflected in the FIR.
