Need advice on false implication under ipc 336

08-Apr-2024 (In Criminal Law)
Police famed me wrongly under 336 on a matter related to stone hitting a 5 year old boy passing by on a motorcycle with his parents, suffered minor injuries as per chargesheet. The initial FIR was in AGYAT and they have framed me now, surprisingly using the complainant as witness. I have got the bail, I don't want to go through long trial, what are my options? What is the likelihood of discharge, If I file discharge petition?

U can directly approach high court under 482 CRPC for quashing of FIR as that has been erroneously filled against u as it. The high court has powers to stay the trail and call the records of the case and can quash the false FIR .Discharge petition generally gets rejected in trial courts .
