21-Jan-2023 (In Criminal Law)
Hi SIR, My father passed away on 2007. With my sign my sister sold all the property and she took all money and she says all money are lend for debts . but she took all money and leading a luxury life where else i am suffering a lot to carry my life. I want to know in which site i can mail my complains so that she will caught and give my share so that i can breath.
When the property stands in name of your father and you and your sister are only legal heirs of your father as told by your good self and in that time you need to file suit for partition, permanent injunction.mesne profits and declare the sale deed as void further you can question your consent for sale deed on the basis of undueinfluence and misrepresentation.the suit should be filed before concerned civil court on the basis of both pecuniary and monetary jurisdiction.limitation for suit to declare of sale deed is 3 years from the date of deed or from date of your knowledge.
Send a lawyer notice to your sister regarding the amount which is due. Wait for 30 days for the reply. If the reply is in positive manner its OK otherwise you can file a civil suit to get your share amount and if she has the property we can attach and get the relief.
