My neighbor has given my family members name and phone number as a surety without our consent and also we haven't signed any papers for the same in kotak bank credit card and now bank is calling us to pay the outstanding amount of the credit card he used. So under which section the police complaint can be filled?

Your neighbour has cheated you and therefore it is a criminal offence. You may file a detailed complaint before the nearest police station against your neighbour. The complaint should be meticulously drafted, better to be done under the supervision of an advocate of your choice.

You can file a Case for Bank Fraud. First, ask the concerned Bank to show the Documents claiming your family as the Surety to pay the Debt in case if he defaults by using Credit Card, then prove, that your consent was not taken & as such, such Document holds no relevance & it is a Null & Void Document.
