28-Jul-2025 (In Criminal Law)
Some scam worth 80 cr was done where government money was transferred to some people from fake government account and withdrawn ultimately by government employees. The people whose accounts were misused to withdraw that money includes my friend who is arrested in section 409,420,467,468,471,120B along with him 2 of his partners also arrested and 7 other beneficiaries as well and one government employee mastermind as well. When to go for bail before or after challan? Should we get it rejected ?

Hello, The amount was credited to your friend’s account from a fraudulent government account. In cases of cyber fraud, it is crucial to determine at which stage or “layer” the money was received. This helps in understanding the level of involvement and liability, if any. I will need more detailed information regarding the nature of the transaction and how the money was transferred. As for the bail aspect, it is advisable to wait until the chargesheet (challan) is filed, and then apply for regular bail accordingly.

you can apply for bail before and after challan. there is no bar on that to file. even one can apply for anticipatory bail in that matter before sessions court and the Honble High court. granting or non granting depends on prima facie case parameters and liberty of accused. balancing of interests criteria. for further consultation you can contact me.
