Section 340 requires the Court desiring to put the law in motion to prefer a complaint either suo motu or on an application made to it on that behalf. But the section does not make it obligatory upon the Court to make a preliminary inquiry in every case before starting prosecution.A false statement in an affidavit before a court amounts to an offence of perjury, which may be punished under Section 193 of the IPC or under other relevant sections. At the same time, deliberately making a false statement in an affidavit before a court may also amount to contempt of court. so my suggestion go with 120-B , so you can get more benefits. it is a very simple process which any concerned district court practicing lawyer can take you through. reaching out to lawyers through internet for such purposes may not be always fruitful. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi University), Advocate, Hon'ble High Court, Calcutta
