Is he made as an accused? Its now crucial to apply for bail or anticipatory to avoid arrest and harassment by police. Then its left on investigation to conclude. Depending on investigation the court will acquit the accused.

First and foremost he has to obtain anticipatory bail from the sessions court. After obtaining bail he will have to cooperate with the police to carry out the investigation and after investigation the police can file a charge sheet (if the case is made out) or b report (if there is nothing incriminating against the accused). During investigation there is an option of filing a criminal petition to the High Court under section 482 cr.p.c for quashing of the FIR. The petition under Section 482 crpc can also be filed if the police files a charge sheet challenging the charge sheet.

Dear Sir,
There are remote chances of conviction for the offence punishable under Section 306 IPC. Several times there are a proposal to delete this section from statute book. Anyway you should not be negligent while dealing with the case. Cross examination is very important in criminal case as such get the witness cross examined by an experienced by criminal lawyer.
