My brother is being framed in murder case

Hello sir, Our neighbor child had been missing since 08.02.2017. They lodged an FIR at local police station. On dated 18 feb 2017 , missing child dead body was found. Police arrested one accused person and he confessed the crime but at the same time he said my brother has promised him to give one lakh rupees , so he kidnaped and killed that child.But my brother totaly denied the allegations and saying ,he never had any type of conversation with the accused, both in physically or over phone.According to police, our family is having enmity with the victim's family which is not true as we shared good relation before arrested. Police forwarded my brother and the accused to jail under 363,302,201,120(b). In CDR it is found no connection between accused person and my brother. Till date police has not given CD to the court. Please help me ,How to get out my bro from jail. At present bail petetion is at session court which is pending due to CD.

You contact local police or investigating offer of the said case to submit CD or ask your advocate he will able to do the same . Is sessions court rejected the bail application then approach Honorable high court where you will got bail

In a Criminal case it is not possible to suggest anything without going through the records/161 statements and other papers. Anyway as understood, it seems to be a case where your brother is implicated on the basis of the co-accused statement, which is not acceptable in law*.
Wait for the order of the Learned Sessions Court. If you don't get bail their, you can file a bail petition at High Court.

In 302,120B and other secs you may not get bail until you prove primafacie no connection to the offence.Approach PS IIC to send the CD.In case You fail to get the bail find out a suitable kawyer to file a CRLA in HC with all relevant factd.U/S173 DJ can direct re investigation.
