if a chargesheet is filed you can go for quashing of chargesheet under Bhartiya nyaya Suraksha sanhita, in Bombay High Court what your advocate is referring to might be a discharge application which is filed in the trial court, if the discharge application is allowed you will get discharge directly from the case, but in 498A High Court usually quashes the FIR or criminal case if there is no evidence on leveled allegations

Your advocate may be advising against quashing of a 498A chargesheet because once a chargesheet is filed, High Courts are cautious and quash only in exceptional cases. If there are specific allegations, medical evidence, witness statements, or disputed facts, the Court may feel they require trial. Also, if no full and voluntary settlement exists or the wife is opposing quash, chances reduce. In such situations, discharge, compounding (if permitted), or facing trial with strong cross-examination may be a safer and faster strategy than a risky quash petition.

Yes, anyone can apply for quashing of a 498A charge-sheet before the High Court under Section 482 CrPC. If both parties are willing to settle the dispute amicably and file consent affidavits, the Court normally allows mutual quashing to bring an end to litigation and restore peace between the parties.

Filed before the trial court 4G 89 Argue that there is no sufficient ground to proceed Less risky than High Court quashing Commonly preferred by advocates This is the most common alternative 2 Anticipatory / Regular Bail (if not already taken) Ensure liberty Reduces pressure during trial 3 Compounding / Settlement (If possible) If husband-wife dispute is matrimonial Mutual consent divorce + settlement Then quashing becomes much stronger

Your advocate is suggesting not to move for quashing of the 498A chargesheet because, in such cases, the High Court usually only allows quashing if the allegations are completely false or malicious. Since the chargesheet already shows prima facie evidence of domestic cruelty, the court may reject a quashing petition outright. Proceeding with the trial is considered safer because it allows your advocate to present your defense, cross-examine witnesses, and prove your innocence. This approach gives a better chance of acquittal rather than risking dismissal of the quashing petition. Regards, AARS Legal Associates
