At he end he will be acquitted. No need to worry. And these are non compoundable offences. Ismein settlement nahi ho sakti. Baad mein jeetne ke baad damages ka case dal dena. You do not have to worry since it is a fake case and judges take utmost care to decide such cases

This is a serious legal matter involving POCSO (Protection of Children from Sexual Offences Act) and Section 376DA IPC (gang rape of a minor). Since your son is a minor (15 years old), the case will be handled under the Juvenile Justice Act, and his rights as a child in conflict with the law will be considered. Legal Aspects & Possible Actions: 1. Lack of Evidence Against Your Son If the prosecution has no medical proof, eyewitnesses, or other supporting evidence except Section 164 CrPC statement (victim’s statement before a magistrate), this can be challenged. Courts generally look for corroborative evidence like medical reports, forensic reports, or independent witness testimony. 2. Medical Report in Your Favor If the medical report does not support the allegations, this is a strong defense. The girl’s side is claiming the incident happened a month earlier, possibly to avoid contradictions in the medical report. However, delay in filing an FIR raises questions about credibility. 3. Cross-Examination of Victim’s Statement Section 164 CrPC statements are not conclusive proof; they need to be tested in court. During cross-examination, contradictions in the girl’s statement can weaken the case against your son. 4. Juvenile’s Rights & Bail Application Since your son is a minor, you should immediately file for bail under the Juvenile Justice Act. Courts often grant bail to minors unless they believe the child is a danger to society. 5. False Case & Malicious Prosecution If you believe the case is false and filed for monetary gain, you can: Collect digital proof (messages, calls, or any demands for money). File a counter-complaint under Section 182 IPC (False information with intent to cause harm) and Section 211 IPC (False charge of an offense). Request a police investigation into financial transactions of the girl’s family. Adv. Mahinder Singh Mavi
