Multiple rape cases on same man by same woman

Once a woman filed a case against a a man of 376 on false promise of marriage and the case is still on the person went to jail and came out on bail and again that lady moved closer to him and also had sex with him by saying i had done mistake i will take case back and again she is threatening i will file a case again if you dont marry me despite the fact the first case is still on pre trial stage.. Is it possible to her to file again a rape case

Hi, Please note that each offense is treated as a separate incident and is tried under distinct charges. For your first question, she can file again a case under Section 376 of the IPC. Secondly, Section 376 of the IPC, or any related provisions under the BNS, is non-compoundable in nature. Therefore, she cannot compromise on or withdraw the case. In this case, the defense can argue consent on the part of the woman. If it appears that she willingly or freely consented to engage in intercourse, it cannot be stated as rape. .

promise of marriage is not rape unless it is proved the appellant had in bad faith and with mala fide intentions held out a false promise of marriage from the inception of the relationship Better to go quash in High Court

hi if she had filed a case again then you could file quash petition on the ground that you were not connected to the case and that she is filing with all false allegations and that you were not connected to allegations mentioned in it
