you will have to file a written complaint to the police ( a copy to the superintendent of police) detailing the events of cheating and fraud done by the builder. It is better to get the complaint drafted by the advocate mentioning what all sections be added to the FIR... recently the HC has upheld sections of MPID Act against a builder. yes you may proceed with filing of an MPID case against the erring builder before the sessions court as also filing of a complaint with the RERA even if the project is unregistered..
law will take its own course however you shall not restrict yourself from going before the court
