Mother and father abuses the child and father is a civil servant (IRS)

28-Mar-2025 (In Criminal Law)
I'm fighting a Domestic Violence case which will lead to the fall of the BJP Government. This DV complaint includes child abuse by mother and bribery by father. Mother abuses the child and father is a civil servant. The child has been expelled from 5 schools for showing symptoms of child abuse. All civil servants, The police or the government commissions refuse to acknowledge the complaint.

you can approach the court for enforcement of your fundamental right to education and can file against the delinquent and if your cause is genuine, the court will pass appropriate order in your favour, including readmission of the child in the school and may pass other orders.

If the police refuse to act, you can approach the court for intervention under the relevant provisions of law. A writ petition in the High Court may also help. We can carve out solution based on the facts and circumstances of your case.

This is a grave matter involving allegations of domestic violence, child abuse, and bribery, with severe implications for both the child’s well-being and governance. If state authorities, including the police and commissions, are refusing to acknowledge the complaint, you may consider the following legal avenues: 1. Approaching the High Court or Supreme Court: Filing a Writ Petition (Mandamus) under Article 226 or 32 of the Constitution can compel authorities to act on the complaint. 2. Juvenile Justice Board (JJB) & Child Welfare Committee (CWC): Since the child has exhibited symptoms of abuse, these statutory bodies have a duty to intervene. Non-action can also be challenged. 3. Filing a Complaint with the Vigilance/CBI: If the father, a civil servant, is involved in bribery, complaints can be filed before the Central Vigilance Commission (CVC) or even the CBI if the magnitude is significant. 4. National & State Human Rights Commissions: Complaints regarding child abuse and administrative inaction can be submitted to the National Human Rights Commission (NHRC) and National Commission for Protection of Child Rights (NCPCR). 5. Media & Public Interest Litigation (PIL): Given the serious public interest, exposing institutional failures through media or a PIL in the High Court can ensure accountability.
