Misappropriation use of fund by owner what can i do legally

Our president of flats owners used the fund of rs. 1,20,000.00 for his own business. But how to establish and how to collect evidence? should we file complaint to police or the magistrate ?

HI, You can file the complaint in the concerned police station. you need to show on what basis you are claiming misappropriation of funds for personal use. you can file the RTI in the office of the society(CGHS) if you need any record or documents. If the police officials don't register the FIR you can file the application in the concerned court court u/s 156(3). Thanks

If you have receipt of the money given by you and other flat owners . You can ask him for giving details of expenses and utilization of money. If he denies for that you can file police complaint for breach of trust and of fraud. Ypu have tl collect receipt or proof like bank transactions for that. Other flat owners should support you for that. You should file a police complaint as a group not as an indivdual.
