What is the Maximum days required to take medical test evidence for rape victim.Can victim file rape case even after one month??

As per Section 164A of Criminal Procedure Code victim should be send for medical test within 24 hours of filing of complaint. Also please note that there is no time limit to lodge complaint of heinous crimes like rape though delay in lodging complainant has may have damaging effect on merits of the case.

yes in criminal law you can file a case even after ten years. no need to worry about it , medical test evidence can be taken just after the FIR has been registered, so there can be delay in registering FIR or complaint but still there are strict laws for women

Rape victim can file case anytime ! More u delay will give benefit to accused ! So I’m case if u want to do such complaint on real incident then u may hire an expert advocate to understand the legalities n to draft your complaint
