I’m a 50-year-old Canadian citizen (woman) from India. Chargesheet filed under IPC 467, 468, 471, 420- Nov2024. I missed a hearing, leading to an NBW. LOC was issued latercanceled. Anticipatory bail granted earlier. Filed quash in HC under Section 482.To cancel the NBW and get exemption to appear in court for an year, should I petition the HC or lower court? I am in Canada now. As you are saying, that, an Anticipatory Bail has been granted to you, it means, that, Non Bailable Warrant issued against you has already been cancelled. As you are saying, Quashing Petition has been filed in the concerned High Court, so that Petition has been filed to seek clean chit from the Court by cancelling/dismissing the FIR and Criminal Proceedings lodged against you. However, if you want to seek an exemption to not appear in Court for a year, then, for that, a request can be made by you via your lawyer in the concerned High Court and in other courts, where your case has been going on.

You can file a Petition before the Bombay High Court or the lower court (depending on where the matter is pending). The High Court would likely have jurisdiction over your Quash Petition, and it can also entertain the exemption request as part of that. You can request exemption for a specific period on the grounds of being outside the country. You can appoint a lawyer in India to represent you in the court hearings and file the necessary Petitions on your behalf, including for the exemption. since you are saying that the husband Ghost by the High Court not go because it is an error on the part of the door code the lower code was not aware that the fire has been cost there can be an advocate who can be appointed who can make the Kota where who can inform the code that SR husband cost and the nbw has been issued after the question of the fat that what it is bad in law it is void and duffer it is required to be withdrawn the trial court will be draw the nbw which has been issued
