Landlord is neither giving possession nor refunding my money

Dear Sir/Mam, I have taken an office on rent wide NJ stamp paper notarized by notary public. But landlord did not give me the possession on date. After followup and reminders he did not reply on my call and messages. Finaly after 1 week I asked for refund otherwise I will go for legal proceedings. He asked to meet an agent for key. But till then I decided to not opt his office on rent and asked for refund only... Its been one month ago but he did not refund my money and also not picking my phone. Is my case comes under criminal proceedings or I should go with civil suit. Regards Chandan

You should go for a civil suit as in criminal proceeding you wot get anything. keeping your interest in view i would suggest to go for a recovery suit. but in this suit you have to conseal certain things.
