Anticipatory bail is filed under section 438 of code of criminal procedure. Its a discretion of court whether to allow anticipatory bail or reject the same depending upon merit of the case if the case is prima facie made out or not. If district court rejects your ancipatory bail you can approach high court for the relief. Contact me if you want more consultation.
