Kolkata complaint case – warrant recall & exemption advice

07-Jan-2026 (In Criminal Law)
A criminal complaint case (CS) is filed against me in Kolkata Magistrate Court relating to an NBFC loan. I never received any summons. The case status shows “E/R of Warrant” with next date 21-04-2026. Recently, Bangalore police contacted my family but did not show any warrant, only gave intimation and suggested settlement. I live outside West Bengal. Can you appear before the Kolkata court now to file warrant recall and exemption from personal appearance? Please advise process, urgency, and fees

As the case shows E/R of Warrant, urgent action is required. A lawyer can appear before the Kolkata Magistrate Court to file warrant recall and exemption from personal appearance, even if you live outside West Bengal. This should be done before the next date to avoid police action. Police cannot force settlement without a valid warrant. Fees depend on case details. For help in this matter, please contact me.

I deny all allegations made against me. The alleged complaint case pending before the Learned Magistrate Court at Kolkata relates to a financial dispute and is purely civil in nature, though given a criminal colour. I state that I have never been served with any summons or notice from the said court. Any issuance of warrant without proper service of summons is bad in law and is liable to be recalled. I am a permanent resident outside the State of West Bengal and have never willfully avoided the process of law. I am in the process of taking appropriate legal steps through my advocate for recall of warrant and exemption from personal appearance under Section 205 CrPC before the concerned court. I further state that any attempt to coerce, threaten, or pressurize me or my family members in the name of police action or settlement, without showing a valid warrant and following due process of law, shall be illegal and will be dealt with strictly in accordance with law. All my rights and remedies are reserved.

Yes sure. I will need few more details before proceeding with this. If the warrant is in your name then you need to appear before the court. That is non negotiable. We can also take a look at why the summon wasn’t served.

If the case status shows “E/R of Warrant”, it means a warrant has been issued due to non-appearance, often because summons were returned unserved or not received. Since you state that you never received any summons and you reside outside West Bengal, this ground can be taken before the Magistrate. Yes, an advocate can appear before the Kolkata Magistrate Court on your behalf and file an application for recall/cancellation of the warrant along with an application for exemption from personal appearance. In the application, reasons such as non-service of summons, residence outside the jurisdiction, and willingness to cooperate with the proceedings are placed on record. Courts generally consider such applications favourably if filed promptly. It is advisable to act urgently and not wait till the next date, as police may otherwise proceed with execution of the warrant. Till the warrant is recalled, police from another state can only act on proper authorization and procedure. Settlement suggestions by police have no legal force unless done through court. Your immediate priority should be warrant recall and securing exemption. Further course of action, including settlement or contesting the case, can be decided after examining the complaint and case records in detail.

dear Client, Since the case shows “Execution/Return of Warrant,” this is a serious and urgent matter. However, since you were never served with summons, the warrant can be recalled and your personal appearance can be exempted. Immediate Legal Remedies: File a petition under Section 70(2) CrPC before the concerned Kolkata Magistrate for recall/cancellation of warrant, explaining non-service of summons. Simultaneously file an application under Section 205 CrPC seeking exemption from personal appearance, especially since you reside outside West Bengal. If police harassment continues or coercive steps are taken without producing a warrant, a protective petition/anticipatory bail can also be considered. If the complaint is under Section 138 NI Act, scope for compounding/settlement remains open at any stage. Urgency: Please act before the next date (21-04-2026) to avoid arrest, coercive steps, or escalation into a non-bailable warrant. Fees: Fees depend on the court, urgency, and number of applications, but I offer affordable and transparent charges after reviewing case documents.
